Is this the one i hear about that the top part comes loose falls out and drops the camera?

Mine doesn't do that. It's a sturdy build. Maybe too sturdy. One issue though: when used underwater, it starts to fill up with water and the filling noise is captured by camera mic. Workaround: dip stick in water few seconds before filming.

can this be used wuth the back belt?

As long as the connector is a 1/4 screw type it should
